Swimming Prohibited During Dangerous
Conditions: It is recognized that during certain periods of time, as a
result of a combination of environmental conditions, dangerous riptides and undercurrents
occur in the ocean surf making ocean conditions unsafe for swimmers. In order to
protect people from these hazards the Town of Kitty Hawk has implemented a red flag
warning system that is designed to warn individuals of such conditions. People who
ignore this warning system endanger not only their own life, but also that of the public
officials who are charged with protecting them. Therefore, these individuals shall
be held accountable for their actions.
*The town may impose a civil penalty of $250.00 for EACH violation of
this section. Violations of this sections shall be enforceable to civil action in
the nature of debt if not paid within ten days of the citation date. In addition,
the town shall have the right to enjoin multiple violations by a person by a civil action
of injunction relief.
Glass Containers Prohibited: The
possession of glass beverage or glass food containers on
town-owned or operated beaches within the town, or on beach access areas, the
town-operated bathhouse, or town parking areas is unlawful.
Dogs on the Beach:
Owner/handler must remove feces and possess a bag/container for waste removal at all times. From
Friday before Memorial Day until the day after Labor Day between the hours of 10:00 am and 6:00 pm
dogs must be on a leash not exceeding 6 feet. At all other times, dogs must be restrained on a
leash retractable to 12 feet. Dogs may be taken off the leash only if they will not disturb other
people on the beach. Unleashed dogs must be controlled by the handler, who must remain within
30 feet of the dog at all times. Leash must be with the handler at all times.
Surfers to use Leashes: If you surf
in the Atlantic Ocean, you must be attached to the board with a line capable of
restraining the board to you. The line must be no longer than twice the length of
the board.
Engine Powered Watercraft:
Launching prohibited. It is unlawful to launch, land, or otherwise beach any
engine-powered watercraft from the Atlantic Ocean beach in the town.
Vehicles on the Beaches: Vehicles on the beaches are prohibited except for
a) commercial fishermen holding a valid state commercial fishermen's license when engaged
in commercial fishing activities
b) town and/or emergency vehicles
Fires on Beaches: It shall be unlawful for any person to ignite, cause to be ignited,
or maintain a fire on the ocean beaches within the town of Kitty Hawk.
